Civil Partnership legal advice

Since 2013 same-sex couples can get married in England and Wales. Some people however, still prefer to form a civil partnership. Since February 2020, both same-sex and opposite-sex couples can enter into a civil partnership.

By entering a civil partnership, couples are offered the same legal rights and protection as married couples should their relationship come to an end. Many of the benefits are similar to marriage.

A civil partnership is formed by signing a document as opposed to making vows. There is no need for a religious ceremony or celebration to be included in the formalities. In addition, legally, a civil partnership is dissolved instead of a couple going through divorce proceedings.

Civil Partnership Agreement

Prior to entering into a civil partnership, it is advisable to draw up an agreement. This will make provision for the possibility of the relationship breaking down in the future, especially if you have lived together for a long time before entering a partnership because without a detailed agreement, a Court may take the view that your partner is entitled to a share of all your assets. A civil partnership agreement is a good way of clearly setting out your intentions, recording the starting point agreed on financial assets and intentions should you split up.

Civil Partnership dissolution
